These terms outline the specific conditions for my “Design On-Demand” service. By using this service, you agree to the following terms.
1. Onboarding Down Payment (Deposit)
1.1. A non-refundable onboarding deposit of £495 is required before the commencement of any work. This deposit will be credited towards your account and used to cover the costs of services as they are rendered.
1.2. The deposit secures your access to the “Design On-Demand” service and ensures that work can begin promptly.
2. Service and Time Tracking
2.1. All work performed under the “Design On-Demand” service is logged in real-time. The time spent on your project will be tracked and documented through timesheets down to 1-minute intervals.
2.2. Timesheets will be included with each monthly invoice, detailing the time logged for the previous period.
2.3. If you wish to review timesheets before the monthly invoice is issued, you may request to view your current monthly spend at any time.
2.4. Setting a maximum monthly spend on your account is possible. You will be notified when this limit is reached.
3. Invoicing and Payment
3.1. Invoices will be issued on a monthly basis, reflecting the time logged and services provided during the previous month.
3.2. Payment of any outstanding balance is required within 7 days of the invoice date.
3.3. Failure to settle outstanding invoices within the specified time frame will result in your account being placed on hold.
3.4. While your account is on hold, no further work will be completed until payment is received in full.
4. Account Suspension and Legal Action
4.1. If payment is not received within 28 days after your account is placed on hold, I reserve the right to suspend your account indefinitely.
4.2. Continued non-payment may result in legal action to recover the outstanding debt, including but not limited to taking the matter to court.
5. Client Responsibilities
5.1. The client is responsible for monitoring the time logs and ensuring that sufficient funds are available to cover ongoing work.
5.2. It is the client’s responsibility to review invoices and timesheets promptly and make payments within the specified time frames.
6. Service Cancellation
6.1. You may choose to cancel the “Design On-Demand” service at any time by providing written notice to [email protected].
6.2. Any remaining balance from the onboarding deposit will be used to cover any outstanding costs.
6.3. Please note that the onboarding deposit is non-refundable. Any excess funds from the deposit will not be refunded and will be retained as part of the service agreement.
6.4. If the cost of services rendered exceeds the deposit, the outstanding balance will be due immediately upon cancellation.
7. Governing Law
7.1. These terms and conditions are governed by and construed in accordance with the laws of England and Wales.
7.2. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
